RETENTION OF OWNERSHIP CLAUSE (law no. 80335 of 12/05/80): On the other hand, in execution of the law of 12 May 1980, the goods delivered remain the property of CHAMPAGNE MAITRE GEOFFROY until full payment of its price by the buyer. In the event of non-payment for the goods delivered, the seller may, without notice, demand the return of the goods which have been the subject of this retention of title clause.

APPLICATIONS: “The customer” declares to expressly accept these general conditions of sale. Any derogation must be the subject of a written document signed by both parties.

ORDER: Any order accepted by the seller is considered firm and final.

DELIVERY: Our goods travel and are unloaded at the risk and peril of the recipient who will check their condition upon delivery and make all necessary reservations with the carrier in accordance with Articles 105 and 106 of the Commercial Code. He must also, within 3 days of receipt of the goods transported, notify the carrier, by extrajudicial document or by registered letter, of his reasoned protest on pain of losing any recourse against the carrier.

PAYMENT: Payment is made in cash without discount and without discount.

LATE PAYMENT INTEREST: Any sum unpaid on its due date will automatically and without formal notice produce late payment interest calculated according to the legal rate in force. For any payment after the due date, a fixed compensation of €40 will be payable. applied to cover collection costs. (Art. D. 441-5. Twelfth paragraph of I of Article L. 441-6 of the Commercial Code)

PAYABILITY BEFORE TERM: In the event of payment of invoices in several instalments, non-compliance with a deadline immediately and without formal notice results in the payment of the entire debt.

PENALTY CLAUSE: In the event of collection by a third party (collection agency, lawyer or bailiff), a penal indemnity calculated on a flat-rate basis at the rate of 10% on the total amount due will be due.

ATTRIBUTION OF JURISDICTION: It is expressly agreed that any disputes to which the supply of our products may give rise must be brought, even in the event of multiple defenders or warranty claims, before the commercial court of REIMS.
